Clinton County Standard Parenting Schedule
It is hoped that parents can voluntarily arrive at a mutually agreeable parenting schedule for their children. Liberal parenting time between both parents and their children is encouraged. Parents who are unable to agree upon a parenting schedule shall follow the schedule set forth below.
A. INFANTS: 0 –4 MONTHS
For infants up to four months of age, the non-residential parent may spend time with the baby in the residential parent’s home three days per week, for one and one-half hours per visit. If the parties cannot agree as to the days and times, the following schedule shall be followed: 4:30 p.m. to 6:00 p.m. on each Sunday, and 6:00 p.m. to 7:30 p.m. each Tuesday and Thursday evening.
B. INFANTS: 4 MONTHS – AGE 1
- Beginning at four months of age through age 1, the nonresidential parent may spend time with the child(ren) away from the residential parent’s residence every Tuesday and Thursday evening form 5:30 p.m. to 8:30 p.m. and one day each weekend, alternating between Saturday and Sunday, from 10:00 a.m. to 6:00 p.m.
- Christmas Parenting Time: For child(ren) four months of age through 12 months of age, the non-residential parent shall be entitled to additional parenting time from 3:30 p.m. until 8:00 p.m. on Christmas Day.
C. INFANTS: AGE 1 YEAR – 18 MONTHS
- From one year to eighteen months, the non-residential parent may spend time with the child(ren) as follows: every Tuesday and Thursday evening from 5:30 p.m. to 8:30 p.m. and on alternating weekends from Saturday at 10:00 a.m. to Sunday at 6:00 p.m.
- Christmas Parenting Time: For child(ren) one year to eighteen months, the non-residential parent shall be entitled to additional parenting time from 3:30 p.m. until 8:00 p.m. Christmas Day.
- If a child is between the age of one year and eighteen months, and has an older brother or sister over the age of eighteen months which is exercising holiday visitation with the non-residential parent, then the holiday visitation schedule for the infant child shall be the same as the older brother or sister. D. CHILDREN 18 MONTHS THROUGH MAJORITY
- Weekends: Alternate weekends beginning Friday at 6:00 p.m. and ending Sunday at 6:00 p.m.
- Weekdays: Every Wednesday (or other day by agreement) from 5:30 p.m. to 8:30 p.m.
- Holidays and Special Days:
In odd numbered years, the residential parent will have the child(ren) on:
Presidents’ Day: from Friday at 6:00 p.m. to Monday at 7:00 p.m. Easter: from Saturday at 6:00 p.m. to Sunday at 7:00 p.m. July 4th: from 9:00 a.m. until 10:00 p.m. Labor Day: from Friday at 6:00 p.m. to Monday at 7:00 p.m. Christmas/New Years: from December 24th at 9:00 p.m. to January 1st at 6:00 p.m. In odd numbered years, the non-residential parent will have the child(ren) on:
Martin Luther King: from Friday at 6:00 p.m. to Monday at 7:00 p.m. Memorial Day: from Friday at 6:00 p.m. to Monday at 7:00 p.m. Thanksgiving: from Wednesday night at 6:00 p.m. to Thursday at 7:00 p.m. unless the following weekend is the non-residential parent’s regularly scheduled weekend in which case the parenting time shall continue until Sunday at 6:00 p.m. Christmas: from December 21st or the last day of school, whichever is later, at 6:00 p.m. to December 24th at 9:00 p.m. Spring Break: commencing at 9:00 a.m. the day after school recesses to6:00 p.m. the day before school resumes. In the even-numbered years this schedule will be reversed.
If any of the above holidays fall on a Monday following that parent’s regular weekend, then the parenting time will be continuous through Monday evening at 7:00 p.m.
Special Days in addition to the above holidays:
Mother’s Day: shall be spent with the mother from 6:00 p.m. Saturday until 7:00 p.m. Sunday. Father’s Day: shall be spent with the father from 6:00 p.m. Saturday Until 7:00 p.m. Sunday Birthdays: Children’s birthdays shall be celebrated in the home of the residential parent unless the birthday falls on a scheduled parenting time of the non-residential parent. If the child(ren)’s Is birthday falls on the residential parent’s parenting time then the non-residential parent shall have parenting time from 5:30 p.m. to 8:30 p.m. the evening before the child(ren)’s birthday.
- Extended Parenting Time/Summer Vacations and Travel:
The non-residential parent shall have extended parenting time with the child(ren) up to four weeks per year. The extended parenting time for ages eighteen months to four years shall be exercised in weekly intervals and shall be non-consecutive weeks absent an agreement of the parties on the contrary. The extended parenting time for ages four through nine years shall be exercised in weekly intervals not to exceed two consecutive weeks at a time, absent an agreement of the parties to the contrary. The extended parenting time for ages ten years through majority may be taken in any arrangement of weekly intervals including up to four weeks consecutive. If the non-residential parent exercises extended parenting time for four consecutive weeks, the residential parent shall be entitled to parenting time every other weekend from Friday at 6:00 p.m. until Sunday at 6:00 p.m. during this four week period.If the non-residential parent exercises the extended parenting time during the school year, the non-residential parent must see that the child(ren) attend(s) school and all school activities in which the child(ren) is involved in.
he residential parent may also have an extended parenting time with the child(ren) not to exceed two weeks.
Extended weekly visitation intervals shall begin and end on Friday absent agreement of the parties. Each parent must give the other parent thirty days prior written notice of the dates he or she intends to have extended parenting time with the child(ren). In the case of conflict, the schedule of the parent who first gives written notice to the other parent shall prevail.
For any vacation or holiday travel, each parent must provide the other parent with specific destinations, estimated times of arrival and departure, and methods of travel.
NOTE: CHILD SUPPORT WILL NOT BE REDUCED DURING SUMMER VACATION PERIODS SPECIFIED IN THIS PROVISION
E. RULES REGARDING PARENTING TIME
- Conflicting Schedule: In the event of any conflict between parenting time schedules, the following is the order of precedence:
- Holidays
- Vacation periods or Extending Parenting Time
- Weekends and mid-week days
For example, one parent may not schedule his or her summer vacation to include July 4th if July 4th is the other parent’s holiday that year. As another example, the residential parent may be entitled to have the children on the Easter holiday even though it falls on the non-residential parent’s alternating weekend. In this case, the non-residential parent’s weekend shall conclude at 6:00 p.m. on Saturday evening. If any weekend parenting time is missed due to holidays or extended parenting times there shall be no make-up.
- Illness: Visitation which cannot take place because of illness of the child(ren) will be made up the following weekend.
- Telephone and Mail: Each parent must, unless this Court orders otherwise, keep the other parent informed or his or her current telephone number and address within ten days of any telephone or address change. Both parents shall encourage free communications between the child(ren) and the other parent and shall not do anything to impede or restrict reasonable communications by telephone or mail between the child(ren) and their parents, whether initiated by the child(ren) or the parent. Any mail between the child(ren) and either parent shall be strictly confidential and shall not be opened or read by the other parent.
- Transportation difficulties and Grace Period: The transporting parent for parenting times shall have a grace period of fifteen (15) minutes for pick up and delivery if both parties live within thirty (30) miles of each other. If the one way distance to be traveled is more than thirty (30) miles, the grace period shall be thirty (30) minutes. In the event the non-residential parent exceeds the grace period, that period of parenting time is forfeited unless prior notification and arrangements have been made and excepting cases where the non-residential parent lives in excess of thirty (30) miles away and suffers an unavoidable breakdown or delay en route and the non-residential parent promptly notifies the residential parent by telephone of the delay.
- Change of Residence of Either Parent – Required Notification: Both parents shall give written notice to the other parent immediately upon any intent to change address or phone number unless a restrictive order has been obtained form the Court. A copy of this notice shall be provide to the Clinton County Court of Common Pleas, Clinton County Court House, Wilmington, Ohio 45177.
- Access to School, Medical and Other Records – Access to School Activities and Child Care Centers:
- General: Both parents shall have access to the children’s same records, same school activities, and to any day care center which the child(ren) attend on the same basis that records or access is legally permitted to a custodial parent, unless a restrictive order has been obtained from the court. It is the responsibility of the parent obtaining the restrictive order to serve it on the appropriate organization.
- Specific: (unless a restrictive order has been issued) The residential parent shall promptly transmit to the non-residential parent any information received concerning teacher meetings, school club meetings, school programs, athletic schedules, and any other school or church activities in which the children may be engaged or interested. The non-residential parent shall be responsible for the child(ren)’s participation in the aforesaid activities during any period of visitation.
The residential parent shall furnish to the non-residential parent a photocopy of the child(ren’s) grade card or report, and copies of any other reports concerning the children’s, status or progress.
